Terms And Conditions

THE SIMPLE VERSION

We know no one likes reading terms of services, but we’ve been told we need them so here they are!

They are important and we’d appreciate you reading them but just in case you overlook anything here are the highlights written in plain language:

  • You must have a valid and active real estate license to use myRealPage services.
  • You are responsible to ensure you site is compliant with MLS®, Real Estate Board, Provincial and Federal rules. We ensure our your website does this by default. Any changes you make which may change this are your responsibility.
  • If we change our pricing (we have only done this once in 12 years) we will give you 30 days notice.
  • There are no refunds for a partial months used.

Those are the big ones written in plain language. Here are all of them which we do ask you review.

GENERAL CONDITIONS

  1. The agreement between myRealPage.com (“MRP”) and the client named in this order form and Contract Agreement (the “Client”) is comprised of these terms and the selected products and features for the length of the term chosen.
  1. The products and services provided my MRP are intended for the sole use of the Client and their representatives.
  1. The Client warrants that he/she holds a valid Real Estate License, and has the consent, as applicable, to enter into this Agreement from the local Real Estate Board, Broker and any other authority required.
  1. The Client is responsible to adhere to all local, provincial, state and national MLS® rules and regulations, and local laws. myRealPage is not responsible nor liable for any actions taken by the client that may violate any MLS® rules and regulations, and local laws.
  1. You expressly understand and agree that MRP shall not be liable for any direct, indirect, incidental, special, consequential or exemplary damages, including but not limited to, damages for loss of profits, goodwill, use, data or other intangible losses (even if MRP has been advised of the possibility of such damages), resulting from: (i) the use or the inability to use the service; (ii) the cost of procurement of substitute goods and services resulting from any goods, data, information or services purchased or obtained or messages received or transactions entered into through or from the service; (iii) unauthorized access to or alteration of your transmissions or data; (iv) statements or conduct of any third party on the service; (v) or any other matter relating to the service.
  1. MRP’s liability for any claims made by the Client or third parties will be limited to the fees charged and collected from the Client by MRP, up to a maximum of the initial 12-service period.
  1. Both MRP and the Client acknowledge that there are no other terms of this Agreement except those expressively contained within.

COPYRIGHT AND CONTENT

  1. The Client acknowledges that the content added to the provided web site by the Client is their sole responsibility and not in any way the responsibility of MRP (even when content is posted by others who have access to their account). The client is entitled to remove, retain and reuse any content added by the client at any time including if choosing to no longer use myRealPage services.
  1. The design of the web site, and the content provided by MRP, including but not limited to the graphic design, computer coding, marketing materials and technical processes are owned by MRP, and cannot be copied, altered in any way or distributed by the Client. The Client does not own any of the web site design or content in any way, except that content developed and added to the provided web page template by the Client.
  1. myRealPage reserves the right to identify itself as the service provider. In the case of using a myRealPage theme, myRealPage will identify itself as the designer and owner of the web page design, layout and stock content. myRealPage will place one hyperlink and logo or equivalent on the web page alongside the other links on the web page template, that will direct the user to another web location operated and managed by myRealPage. Nothing on these myRealPage linked pages will contain information or associations that are in direct conflict with the business operations of the Client. This logo and/or link may not be removed without prior consent of myRealPage.
  1. The Client must not allow others to alter in any way, copy or distribute MRP products, and must not provide their password to anybody except their representatives, and if breached, will be liable to the damages suffered by MRP.
  2. myRealpage may manually submit the web site on behalf of the Client via authentication methods required by Google Search Console and/or Bing Webmaster Tools.

CHANGES TO SERVICES AND PRICING

  1. MRP has the right to improve current technology and support capabilities, as long as the service levels provided to the Client are maintained or improved.
  1. Prices of all Services are subject to change upon 30 days notice from MRP. Such notice may be provided at any time by posting the changes to myRealPage.com or the Service itself.
  1. MRP shall not be liable to you or to any third party for any modification, price change, suspension or discontinuance of the Service.

PAYMENT, REFUNDS, SUSPENSIONS AND SERVICE CHANGE TERMS

  1. Billing for services provided are billed monthly in advance by the Client. A charge of $10 will apply for any NSF payments, and a late payment charge of 1.5% per month will be charged on any amounts remaining unpaid for more than 10 days after the 1st of each month.
  1. There will be no refunds or credits for partial months of service, service change refunds, or refunds for months unused with an open account. In order to treat everyone equally, no exceptions will be made.
  1. Payments will continue until the services provided have been canceled by the client by completing and submitting a cancellation document provided by myRealPage upon request.
  1. Any questions or discrepancies regarding charges must be reported to us within 60 days of the date of our invoice or other statement. Failure to notify us within this time period will constitute your acceptance of such charges.
  1. For any upgrade or downgrade in your services, your payment option provided at start of services will automatically be charged the new rate on your next billing cycle.
  1. MRP may, without liability, suspend or cancel the services provided if the Client fails to pay fees outstanding for more than 15 days, breaches any terms of this Agreement, or uses or allows other to use MRP services unlawfully.

CANCELLATION AND TERMINATION

  1. You can cancel your account at anytime. To do so, follow instructions at training.myrealpage.com.
  1. The client is responsible for cancelling their account.

By my acceptance, I acknowledge, represent and agree that this order is to be implemented, authorize payment under the plan selected and be bound by all the Terms and Conditions of this agreement.
